Terms of Use

Important: The applications provided by Critical Condition are clinical decision support tools designed exclusively for qualified healthcare professionals. They are not medical devices and must not be used as the sole basis for clinical decisions.
1. Acceptance of Terms
By accessing or using any application ("Apps") developed by Critical Condition Pty Ltd (ABN 24 695 461 057) ("Critical Condition", "we", "us", or "our"), including but not limited to BloodGasPro, CodeClock, IntubAid, LabLogic, METmate, and ResusReady, you agree to be bound by these Terms of Use.
If you do not agree to these Terms, you must not access or use the Apps.
2. Intended Users
The Apps are designed exclusively for use by qualified healthcare professionals who have:
- Appropriate clinical training and current registration with a relevant professional body
- Competency in the clinical domains addressed by each App (e.g., airway management, blood gas interpretation, resuscitation)
- The ability to independently verify clinical information and make autonomous clinical decisions
The Apps are not intended for use by patients, members of the public, or healthcare students acting without supervision.
3. Nature of the Applications
3.1 Educational and Reference Tools
The Apps are educational reference tools and cognitive aids. They are designed to supplement, not replace:
- Clinical training and professional judgement
- Institutional protocols and guidelines
- Senior clinical review and consultation
- Current evidence-based practice guidelines
3.2 Not Medical Devices
The Apps are not registered medical devices under the Therapeutic Goods Act 1989 (Cth) or equivalent legislation in any jurisdiction. They have not been evaluated, cleared, or approved by the Therapeutic Goods Administration (TGA), FDA, or any other regulatory body for use in the diagnosis or treatment of any medical condition.
3.3 Not Medical Advice
The information provided by the Apps does not constitute medical advice, diagnosis, or treatment recommendations. No physician-patient or clinician-patient relationship is created through use of the Apps.
4. Clinical Calculations and Reference Data
Verification Required: All calculations, drug dosages, reference ranges, and clinical parameters displayed by the Apps must be independently verified before clinical application.
4.1 Drug Dosages
Where the Apps display drug dosages (including but not limited to induction agents, resuscitation medications, and sedatives), you must:
- Verify all dosages against current formularies and prescribing information
- Confirm appropriateness for individual patient factors (weight, age, renal function, hepatic function, allergies, contraindications)
- Follow your institution's medication administration protocols
- Accept full prescriber responsibility for any medication administered
4.2 Medical Calculations
The Apps may perform clinical calculations including but not limited to:
- Blood gas interpretation (Henderson-Hasselbalch and Stewart approaches)
- Anion gap calculations and corrections
- Osmolar gap calculations
- Compensation formulae (e.g., Winter's formula)
- P/F ratio calculations
These calculations use mathematical algorithms based on published literature. Clinical context may affect the accuracy or applicability of results. You must apply clinical judgement when interpreting any calculated values.
4.3 Reference Ranges
Reference ranges displayed in the Apps are indicative and may differ from those used by your institution's laboratory. Always confirm reference ranges against local laboratory values.
4.4 Differential Diagnoses and Clinical Pathways
Where the Apps suggest differential diagnoses or clinical pathways, these are provided as memory aids and are not exhaustive. Important diagnoses may be omitted. Clinical assessment must always take precedence.
5. Specific Application Warnings
5.1 BloodGasPro
Blood gas interpretation involves complex pathophysiology. The App supports both Traditional and Physicochemical (Stewart) approaches. Some interpretive pathways may be marked as "ambiguous" where clinical context is required. VBG values have known limitations compared to ABG. The App's interpretation does not replace systematic clinical assessment.
5.2 CodeClock
Resuscitation timing and drug interval guidance must be verified against current Advanced Life Support guidelines. Prognostic information is based on published research and may not apply to individual circumstances. Do not delay resuscitation to interact with the App.
5.3 IntubAid
Airway management is a high-risk procedural skill. Risk stratification tools support but cannot replace clinical assessment. Drug dosing for induction requires individual patient assessment. Equipment checklists are reference guides only; verify against local resources.
5.4 LabLogic
Laboratory interpretation requires correlation with clinical presentation. Reference ranges vary between laboratories and assay methods. The App does not cover all possible causes of abnormal results.
5.5 METmate
Early warning triggers and escalation thresholds are guidelines. Clinical deterioration may occur without meeting App-defined thresholds. Do not delay escalation based solely on App output.
5.6 ResusReady
Team coordination tools support communication but cannot replace team training, simulation, and human factors awareness.
6. Emergency Use Limitations
DO NOT rely on these Apps in time-critical emergencies. The Apps may experience technical failures, delays, or inaccuracies. In emergencies, follow your training, institutional protocols, and clinical judgement. Never delay life-saving interventions to consult an App.
7. User Responsibilities
By using the Apps, you agree to:
- Verify all clinical information independently before application to patient care
- Exercise professional clinical judgement at all times
- Follow your institution's policies, protocols, and guidelines
- Maintain current competency through continuing professional development
- Report any errors, inaccuracies, or concerns to us at hello@criticalcondition.com.au
- Accept full responsibility for all clinical decisions made using information from the Apps
- Not use the Apps beyond your scope of practice or competency
8. Data and Privacy
The Apps are designed to operate without collecting patient data. No patient information, protected health information (PHI), or clinical data should be entered into the Apps.
Local storage on your device may be used to store:
- Disclaimer acceptance records
- User preferences and settings
- Event logs (for timing functions)
This data remains on your device and is not transmitted to us.
9. Intellectual Property
All content, design, code, and functionality of the Apps is the property of Critical Condition Pty Ltd and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Apps without our written consent.
10. Disclaimer of Warranties
THE APPS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- WARRANTIES OF MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT
- NON-INFRINGEMENT
- UNINTERRUPTED OR ERROR-FREE OPERATION
We do not warrant that the Apps will meet your requirements, that results obtained will be accurate or reliable, or that any errors will be corrected.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRITICAL CONDITION PTY LTD, ITS DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY:
- Direct, indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, use, goodwill, or other intangible losses
- Personal injury or death
- Medical errors, misdiagnosis, delayed treatment, or adverse patient outcomes
This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise), even if we have been advised of the possibility of such damages.
You use the Apps entirely at your own risk and are solely responsible for all clinical decisions made using the Apps.
12. Indemnification
You agree to indemnify, defend, and hold harmless Critical Condition Pty Ltd and its directors, employees, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:
- Your use of the Apps
- Your violation of these Terms
- Your clinical decisions or patient care activities
- Any claim by a third party related to your use of the Apps
13. Modifications
We reserve the right to modify, update, or discontinue any App at any time without notice. We may also modify these Terms at any time. Continued use of the Apps after changes constitutes acceptance of the modified Terms.
14. Governing Law
These Terms are governed by the laws of Victoria, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
